TANF participants are required to sign and comply with a social contract as a condition of eligibility. Each household member may be required to comply with certain requirements under the contract. Failure to comply or cooperate with the requirements of the contract and other program requirements may result in a sanction being applied against the responsible individual, closure of the entire case, and a month of ineligibility if the sanction is not resolved. Before a JOBS sanction can be imposed against an individual, an attempt must be made to resolve the dispute through the good cause determination process.

 

All sanctions are first imposed against the responsible individual. The sanction may progress to the entire household if the individual does not cure the sanction by cooperating or participating as required under the contract. If the individual sanction progresses to the household resulting in case closure and a month of ineligibility, the household loses eligibility for TANF until the responsible individual cures the JOBS sanction.

 

One exception is non-cooperation with ND Health Tracks that does not result in a sanction but rather in a 7% reduction in the net benefit until the requirements are met.

 

Sanctions of non-cooperation with Child Support Enforcement or with JOBS; disqualifications due to an intentional program violation, drug disqualification, or alien disqualification; or penalty for non-cooperation with Health Tracks follow the responsible individual.
